To kick this week off with good news, it's just been reported that the Department of Justice has filed suit against the City of Denver to target unconstitutional magazine and gun bans.
Anti-gun municipalities like Denver and Boulder which have ignored the Second Amendment for generations may soon be forced to actually follow the Bill of Rights.
But not all news in Colorado is good this week, and we regret to inform you that TABOR is under attack... again.
HB26-1419 directs the State Controller to recalculate TABOR refunds for fiscal year 2024-2025, to determine how much was over-refunded to We the People.
That's because tax breaks in the so-called "One Big Beautiful Bill" took effect just four days after the fiscal year ended.
Initially, Polis' team planned to keep over $300M in TABOR refunds.
After stating specifically that keeping TABOR refunds "would not be legal," the Joint Budget Committee took half of that ($153M).
Republicans took three swings at getting this bill placed as a question on the November ballot for citizens to vote on, but all their amendments were killed and their efforts struck out.
Ultimately, the bill passed the Colorado House 41-21.
Now, the bill heads to the Senate. So please use the button below to contact your Colorado Senator and tell them this bill violates the Colorado Constitution!
Article X, Section 20 of the Colorado Constitution, which voters approved as TABOR in 1992, reads:
“Withholding tax refunds is not permissible except by approval by a voter referendum under Article 20 of the state constitution."For Freedom,
